In a significant move to strengthen tax administration and improve compliance, the Federal Government has inaugurated an inter-ministerial committee to address the uncertainties surrounding the implementation of Value Added Tax (VAT) under Nigeria's new tax laws.
The committee, inaugurated by the Minister of Finance and Coordinating Minister of the Economy, Mr. Taiwo Oyedele, is responsible for developing a VAT Modification Order that will provide clarity on the practical application of VAT provisions contained in the Nigeria Tax Act, which became effective on 1 January 2026.
Background
The introduction of the new tax laws marked a major milestone in Nigeria's tax reform agenda. However, since their implementation, taxpayers, businesses, and tax professionals have raised concerns over the interpretation of certain VAT provisions, particularly regarding exempt supplies, zero-rated transactions, and the treatment of specific goods and services.
Recognising these challenges, the Federal Government has taken proactive steps to ensure that the VAT framework is clear, practical, and aligned with the objectives of the ongoing tax reforms.
The Committee's Mandate
The committee has been assigned the responsibility of reviewing the current VAT framework and making recommendations that will eliminate ambiguity in the law.
Its responsibilities include:
Developing a comprehensive VAT Modification Order.
Preparing updated schedules of VAT-exempt and zero-rated goods and services.
Consulting with key stakeholders, including government agencies, businesses, manufacturers, tax professionals, and industry associations.
Recommending legislative amendments where necessary.
Producing implementation guidelines to ensure consistent application of VAT across the country.
Why This Matters
A clear VAT framework is essential for an efficient tax system. Uncertainty in tax laws often leads to compliance challenges, disputes, increased administrative costs, and inconsistent tax treatment across industries.
By providing detailed guidance on the application of VAT, the committee's work is expected to:
Improve tax certainty for businesses.
Reduce disputes between taxpayers and tax authorities.
Encourage voluntary compliance.
Strengthen investor confidence.
Promote a more transparent and predictable tax environment.
For tax practitioners, the outcome of this exercise will provide much-needed clarity in advising clients and implementing the provisions of the Nigeria Tax Act.
Implications for Businesses
Businesses should closely monitor developments from the committee, as the proposed VAT Modification Order may affect the VAT treatment of various transactions, goods, and services.
Organisations are encouraged to review their current VAT processes and remain prepared to align with any new guidelines once they are officially issued.
Looking Ahead
The committee has been given six weeks to submit its report, including the draft VAT Modification Order, implementation guidelines, stakeholder consultation report, and recommendations for any additional legislative changes.
As Nigeria continues its journey toward a modern and efficient tax system, this initiative reflects the government's commitment to ensuring that tax reforms are not only comprehensive but also practical and easy to implement.
The committee's recommendations are expected to enhance certainty, simplify VAT administration, and support a more business-friendly tax environment for taxpayers across the country.
